The attack on our gardens:

Update on garden situation: I asked for and received forms and instructions for getting the soil checked for pesticides and herbicides. You have to actually get and MIX soil samples from around your garden and NOT just fence-lines.

I have a form from the State as well. If he miš-used pesticides/herbicides he can get into some real trouble.so my thinking is to send samples a couple places. If they come back hot, we involve the State. We DO have the right to sue for civil damages.

This sounds strange. What would be the point of mixing the samples? Unmixed samples would allow the laboratory to say whether contamination was a general problem or confined to the fence lines, but mixed samples wouldn't tell you anything except that there was a problem somewhere.
