It wasn't "because of his rank", it was because he didn't turn down the opportunity toe be part of Mladic's supporting cast. I seem to remember a report that suggested that other colleagues did, but can't remember the source. What is more interesting than Krstic's weaseling is the fact that the prosecution is not (yet) suggesting that anyone outside was involved.
